CCTV & Webcam Policy

SECURITY AND SURVEILLANCE AT THE CLUB

The Club has legal obligations to protect the health and safety of all people who work at or visit its facilities. In so doing, it has regard to its obligations under the Workplace Surveillance Act (NSW) and to privacy laws and established privacy principles.

There is no covert surveillance, which in any event can only be conducted under a warrant issued by a Court.

In public areas: there is a webcam showing Rose Bay, the launching area, and a small section of the public pathway. This allows members and guests to view conditions on the bay. The footage and sound are not recorded.

The Club reserves the right to suspend or discontinue the webcam feed at any time without notice.

On the premises: CCTV cameras are used inside the clubhouse and in the boat park, in areas deemed appropriate by the Club Committee. No cameras will provide footage of the changerooms or toilets. In compliance with the law, signage erected and maintained throughout the club and the boat park advises people that CCTV is in use. CCTV cameras record movements within the clubhouse and its surrounds, and recordings may be retained as permitted by law. However, CCTV footage may only be accessed in approved circumstances by approved personnel. Currently, approved personnel are the Commodore, the Secretary, and nominated Club Staff.

  • Where a crime or civil wrongdoing is known or reasonably suspected to have occurred in an area covered by the cameras.
  • Where there is a threat to the safety of persons in and about the premises.
  • Where property has been lost and the loss is reasonably believed to have occurred in an area covered by the cameras.
  • Where property has been damaged and/or injury is threatened or has occurred, and the incident is reasonably believed to have occurred in an area covered by the cameras.
  • Where a dispute has arisen, and it is reasonably believed camera footage could assist in its resolution.
  • In case of emergency where it is reasonably believed camera footage is material and relevant.
  • Where required by law or relevant authority, or where reasonably requested by relevant authority.
  • Any other circumstances authorized by the Club Board.

In the discretion of the Club Board, or as legally mandated, footage may be provided to parties external to the club. Such parties could include police, other relevant authorities, professional advisers, and the clubs insurers/insurance broker.

Surveillance is conducted to assist the Club in protecting its employees, members, and guests. To the maximum extent permitted by law, the Club and members of the Club Board will not be liable for any loss or damage howsoever caused (including from negligence) as a result of:

  1. CCTV use in the clubhouse or boat park.
  2. Any recording of footage or failure to record footage.
  3. Non-adherence to this policy.
  4. Actions taken in respect of recorded footage where the persons taking such actions believed on reasonable grounds that such actions were in accordance with this policy.
